Disclaimer and Limitation of Liability

Governing Law

This User Agreement will be governed by the laws of the State of New York applicable to contracts made and performed there without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts sitting in the State and County of New York and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

Termination

We reserve the right to terminate the KHE Site and this User Agreement at any time without notice for any reason, including, in the case of the User Agreement, for your violation of any of its provisions. The Disclaimer and Limitation of Liability and Governing Law sections of this User Agreement shall survive any such termination.

Kaplan Higher Education Privacy Policy

This is the privacy policy ("Privacy Policy") for the Web site ("KHE Site") for Kaplan Higher Education and the college campuses of Kaplan Higher Education (collectively, "Kaplan Higher Ed").

At Kaplan Higher Ed, we understand that our visitors need to be in control of their personal information. This Privacy Policy describes how we treat personal information received about you when you visit our KHE Site.

Collection of Your Data

Personal Data. When you fill out an "Apply Online" form, we ask for your name, email address, postal address, phone number, whether you are a foreign student, whether you will be seeking financial assistance, and current employer. We do not knowingly collect information from children under the age of 18.

When you fill out a “Contact Us” form, we ask for your name, address, phone number, email address, academic status, program of interest, and how you heard about us.

We use the personal data you submit on these forms to contact you about enrollment in our educational programs or to follow up on your request for information. We may also use your data to continue to send you information about other programs we think you might be interested in.

Anonymous Data. We automatically collect IP addresses and Web site usage information from you when you visit the KHE Site. This information helps us evaluate how our visitors use and navigate the KHE Site on an aggregate basis, including the number and frequency of visitors to each Web page, and the length of their visits.

Sharing Your Data

We share your information only with other Kaplan companies and the service providers who help us to run this KHE Site or to fulfill your requests. We may also need to disclose your personal data to third parties if required by law or to enforce our User Agreement or this Privacy Policy, or when we, in our sole discretion, believe it is necessary or appropriate, or in connection with a sale or transfer of some or all of our assets in the KHE Site.

Cookies

We use cookies to allow you to move quickly through our site, to recognize repeat visitors and to allow you to take advantage of some of our site’s special features. Beginning on January 1, 2005, California's "Shine the Light" law provides California residents with the right to receive disclosures about any sharing of their personal information with other companies.

If you are a California resident and you provided your personal information to Kaplan University ("KU"), then, once each calendar year, you may submit a written request for information about the information we shared, if any, with other companies for their use in direct marketing. To submit your written request, please send us a written request, with the words "Request for California Privacy" in the letter subject line, to the following address:
